1. Acceptance of Terms

By accessing or using the Hiringseed platform, you agree to be bound by these Terms of Service. If you do not agree, you may not use the platform. These terms apply to all users, including companies, recruiters, consultancies, and candidates.

2. Eligibility

You must be at least 18 years old and legally capable of entering into binding agreements under Indian law. Companies must be registered entities. Recruiters may operate as individuals or registered firms.

Hiringseed is not intended for use by individuals under 18 years of age. We do not knowingly collect personal data from children as defined under Section 9 of the Digital Personal Data Protection Act, 2023. If you are under 18, you may not create an account or use the platform.

3. Company Obligations

Companies agree to post accurate job descriptions, respond to candidate submissions within reasonable timeframes, and honour the referral fee terms stated at the time of posting. Companies must not contact candidates submitted through Hiringseed outside the platform to circumvent fee obligations.

4. Recruiter Obligations

Recruiters agree to submit only candidates who have given explicit consent to be represented for the specific role. Submissions must be original and not duplicates of candidates already in the company's pipeline. Recruiters must not misrepresent candidate qualifications or experience.

5. Referral Fees & Payments

Referral fees are set by the company at the time of job posting. Recruiters see the exact amount they will earn for each role before they begin working on it. Hiringseed charges a platform fee on successful placements, which is deducted automatically at the time of payout.

Rates may change with 30 days' notice; existing placements honour the rate at time of submission.

6. Candidate Consent & Data

Recruiters must obtain explicit consent from candidates before submitting their profiles. Candidate data is shared only with the company posting the specific role. Hiringseed processes candidate data in accordance with its Privacy Policy and the Digital Personal Data Protection Act, 2023.

7. Payments & Escrow

Referral fees are held in escrow through a licensed payment partner. Funds are released to the recruiter automatically upon confirmation of the candidate's joining milestone. If a candidate does not join or leaves within the agreed guarantee period, the fee is refunded to the company.

8. Disputes

Disputes regarding candidate ownership, submission timing, or fee entitlement are resolved through Hiringseed's internal dispute resolution process. Timestamped submission records serve as the primary evidence. Either party may escalate unresolved disputes to arbitration under the Arbitration and Conciliation Act, 1996.

9. Prohibited Conduct

Users may not:

• Submit candidates without their explicit, informed consent.
• Circumvent the platform to avoid referral fees or commission.
• Create fake accounts, submit fabricated profiles, or manipulate ratings.
• Use the platform for any purpose that violates applicable law.

10. Termination

Either party may terminate their account at any time. Hiringseed may suspend or terminate accounts that violate these terms. Upon termination, any pending escrow payouts for confirmed placements will still be processed. Access to historical data is retained for 90 days after closure.

11. Limitation of Liability

Hiringseed acts as a marketplace and does not guarantee placement outcomes, candidate quality, or payment from companies outside the escrow system. Our total liability for any claim arising from use of the platform is limited to the fees paid by the claimant in the 12 months preceding the claim.

12. Governing Law

These Terms are governed by the laws of India. Any disputes arising from or related to these terms shall be subject to the exclusive jurisdiction of the courts in Gurugram, Haryana.

13. DPDP Act Compliance

Hiringseed is operated by Arhamin Innovations Private Limited, a Data Fiduciary under the Digital Personal Data Protection (DPDP) Act, 2023. Your personal data is processed in accordance with our Privacy Policy, which describes your rights as a Data Principal, including the right to access, correction, erasure, consent withdrawal, and nomination.
